Understanding whether you have a legitimate legal claim based on injuries that you have suffered can be a complicated process.
Suffering a physical, mental, or emotional injury can be an extremely frustrating situation. While you might think that someone owes you something for your injuries, there are several situations where the law won't provide you a basis for recovery.
Generally speaking, there are 3 major legal grounds upon which to base a claim for injury compensation. These are strict liability, intentional torts, and negligence.
In a general sense, strict liability claims usually arise from someone doing some sort of dangerous activity. In these cases, if someone is injured from the activity, a strict liability claim may be brought. These claims are not based on whether or not the person causing the injuries was acting reasonably or not.
Next we have intentional torts. These claims arise when someone intentionally causes harm or damage to another. Like strict liability claims, these cases are much less prominent than claims based on negligence. The classic intentional tort claims are assault and battery (which may also give rise to a criminal case too).
Finally, we come to negligence. Negligence claims make up the overwhelming majority of injury cases in the United States. These claims when someone that owes some else a duty to use reasonable care fails to act reasonably thereby causing injury or damages to another. A typical example of a negligence claim is a car accident case.
